Terms of Service

1. Acceptance of Terms

By accessing or using Sortbox ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is operated by Nicolas Magne, an independent developer based in France ("we", "us", or "our").

2. Description of Service

Sortbox is an intelligent email management and automatic sorting solution. The Service allows users to:

• Connect their Gmail account via OAuth 2.0 authentication
• Automatically organize incoming emails based on email aliases (sub-addressing)
• Create and manage Gmail labels automatically
• Move messages to appropriate folders based on the recipient address
• View analytics about their email organization

3. Gmail Access and Permissions

To provide the Service, we require access to your Gmail account with the following scopes:

• gmail.readonly: To read your email messages and metadata
• gmail.modify: To modify labels and move messages between folders
• gmail.labels: To create, read, update, and delete labels

We will never:

• Read the content of your emails beyond metadata (subject, sender, recipient)
• Delete your emails
• Send emails on your behalf
• Share your email data with third parties
• Use your data for advertising purposes

4. User Account and Eligibility

To use the Service, you must:

• Have a valid Gmail account
• Be at least 13 years of age or the minimum age required in your jurisdiction
• Provide accurate and complete information during registration
• Maintain the security of your account credentials

You are responsible for all activities that occur under your account.

5. Pricing and Payment

The Service is currently in beta and available for free during the testing phase. We reserve the right to introduce paid subscription plans in the future.

When paid plans are introduced, we will notify all users in advance. Continued use of the Service after the introduction of paid plans constitutes acceptance of the new pricing terms.

6. Data Ownership and Privacy

Your Data: You retain all ownership rights to your email data. We only access your Gmail data to provide the Service as described.

Data Storage: We store OAuth tokens and minimal metadata necessary to operate the Service. We implement industry-standard security measures to protect your data.

Data Retention: We retain your OAuth tokens and account data for as long as your account is active. Upon account deletion, your data will be permanently deleted within 30 days.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use automated systems to access the Service without our permission
• Violate any applicable laws or regulations

8. Service Availability

We strive to provide a reliable service, but we do not guarantee that the Service will be:

• Always available or uninterrupted
• Free from errors, bugs, or security vulnerabilities
• Compatible with all devices or configurations

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Damages resulting from unauthorized access to your account
• Any damages arising from the use or inability to use the Service

Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim, or €100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Sortbox and its developer from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Account Termination

By You: You may terminate your account at any time by disconnecting your Gmail account and deleting your Sortbox account through the dashboard.

By Us: We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

12. Intellectual Property

The Service, including its design, code, features, and content, is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or business purposes in accordance with these Terms.

13. Third-Party Services

The Service integrates with Gmail, a third-party service operated by Google LLC. Your use of Gmail is subject to Google's Terms of Service and Privacy Policy.

We are not responsible for the availability, performance, or policies of third-party services.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service.

Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of France.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sortbox regarding the use of the Service.
